ORDINANCE NUMBER 518

AN ORDINANCE IMPOSING A MUNICIPAL PENALTY FOR FAILURE TO REMOVE SNOW, ICE AND ACCUMULATIONS

BE IT enacted by the City Council of the City of Ida Grove, Iowa, that:

SECTION I.

Title VIII, Chapter 2, Article 9 (8.2.09) is hereby amended to read as follows:

It shall be the responsibility of the abutting property owners and tenants to remove snow, ice and accumulations promptly from sidewalks. If a property owner or tenant does not remove snow, ice or accumulations within a reasonable time, the City may, but is not required to, remove the snow, ice or accumulation. If the City so removes, the City may assess the cost against the property owner for collection in the same manner as a property tax. For the purposes of this Article, “promptly” and “a reasonable time” are no longer than 24 hours after the snow or ice stop falling, if from a snowfall, or no longer than 24 hours after the snow or ice was deposited there, if the snow, ice or accumulation was caused by blowing wind or other cause.

Any violation of Subsection 1 by a property owner or tenant is a municipal infraction, subjecting the property owner and/or tenant to a civil penalty of $25. A second violation by the same property owner or tenant in the same fiscal year (July 1 through June 30) shall be subject to a municipal infraction of $50, with the cost increasing by $25 for each subsequent infraction in the same fiscal year, up to a maximum of $500 for each infraction. Each day the snow, ice or accumulations are not removed is a separate municipal infraction.

SECTION II.

WHEN EFFECTIVE. This Ordinance shall be in effect from and after its final passage, approval and publication as provided by law.

SECTION III.

If any portion of this Ordinance is determined to be invalid, such determination shall not effect the remainder of the Ordinance.
