Mayor Ernst presided over the session and called the meeting to order at 6:00 p.m. with the following members present: Fineran, Rupert, Bargar, Carnine and Cates.

Motion by Council Member Fineran to approve the agenda, second by Council Member Rupert. On a unanimous vote motion carried.

Motion by Council Member Fineran to approve Crop Production Services to anchor the fuel containment pad on the apron as long as the holes for anchoring are winterized properly, second by Council Member Bargar. On a unanimous vote motion carried.

Motion by Council Member Fineran to approve Principal Option #4 with a $1000 deductible, second by Council Member Rupert. Call for votes. Ayes: Fineran and Rupert. Nays: Bargar, Carnine and Cates. Motion defeated.

Motion by Council Member Bargar to approve Principal Option #7 with a $250 deductible, second by Council Member Carnine. Call for votes. Ayes: Carnine, Bargar. Nays: Fineran, Rupert and Cates. Motion defeated.

Motion by Council Member Cates to approve Principal Option 1 with a $500 deductible, second by Council Member Carnine. Call for votes. Ayes: Carnine, Bargar, and Cates. Nays: Rupert and Fineran. Motion passed.

Motion by Council Member Bargar to approve the consent agenda, second by Council Member Carnine. On a unanimous vote motion carried.

Motion by Council Member Carnine to approve pressure grouting and mud jacking for the 1100 block on Valley View Drive, second by Council Member Fineran. On a unanimous vote motion carried.

Motion by Council Member Rupert to approve the City Clerk to attend IMFOA Spring meeting on April 15-17, second by Council Member Carnine. On a unanimous vote motion carried.

Motion by Council Member Carnine to approve the rental agreement for $1.00 with the Farmers Market in the City Park shelter house and parking lot from June 19 to October 30, second by Council Member Rupert. On a unanimous vote motion carried.

Motion by Council Member Rupert to approve Resolution 2009-4 for adopting the annual budget, second by Council Member Fineran. On a unanimous vote motion carried.

Motion by Council Member Fineran to approve Resolution 2009-5 authorizing the execution of the Iowa Department of Transportation Agreement for the Federal Stimulus Program, second by Council Member Bargar. On a unanimous vote motion carried.

Attorney Goldsmith advised the City to notify members on the Community Foundation there are plans to update the members.

Motion by Council Member Cates at 6:54 p.m. to close the regular session and open the executive session per State Code 21.5(c) to discuss strategy with counsel in matters that are presently in litigation, second by Council Member Fineran. Call for votes: Ayes: Cates, Fineran, Bargar, Rupert and Carnine. Nays: None. On a unanimous vote motion carried.

Motion by Council Member Rupert to close the executive session with no motions or actions taken at 7:04 p.m. and reopen the regular session, second by Council Member Cates. Call for votes: Ayes: Rupert, Cates, Fineran, Bargar, and Carnine. On a unanimous vote motion carried.

Motion by Council Member Cates to authorize legal counsel to proceed with municipal infractions on the Papes and trustees of the Baxter Hotel, second by Council Member Carnine. On a unanimous vote motion carried.

Motion by Council Member Bargar to adjourn, second by Council Member Rupert. On a unanimous vote motion carried.

Meeting adjourned at 7:05 p.m.
