Mayor Ernst presided over the session and called the meeting to order at 6:00 p.m. with the following members present: Bargar, Carnine, Cates, Fineran and Rupert.


Motion by Council Member Fineran to approve the agenda with the addition of the Compost Pile and Farmers Coop Community Service Day, second by Council Member Bargar. On a unanimous vote motion carried.


Mayor Ernst opened the public hearing on Ordinance 528 adding a new section on Mowing of Properties to the City Code of Ordinances. City Clerk Ball reported there have been no written or verbal comments on the ordinance. Mayor Ernst opened the regular City Council meeting.


Motion by Council Member Carnine to reimburse Amanda Lichtenberg $45 to cover the $20 donation and help pay mileage when transporting stray dogs to the Sioux City Humane Society, second by Council Member Cates. On a unanimous vote motion carried.


Matt Salvatore, Recreation Director, reported the Outdoor Pool Improvement Project has received a boost in pledges from the Harold W. & Leone L. Godbersen Family Foundation, Gary and Sharon Godbersen, the Gomaco Corporation, and United Bank totaling $160,000. Motion by Council Member Rupert to complete the project after the pool closes in the fall of 2010 during FY2011, second by Council Member Carnine. On a unanimous vote motion carried.


Motion by Council Member Rupert to approve the consent agenda, second by Council Member Carnine. On a unanimous vote motion carried.


Mayor Ernst closed the public hearing on Ordinance 528 Mowing of Properties. Motion by Council Member Fineran to approve Ordinance 528 adding a new section on Mowing of Properties to the City Ordinances, second by Council Member Bargar. On a unanimous vote motion carried. Motion by Council Member Carnine to waive the second and third readings of Ordinance 528 Mowing of Properties, second by Council Member Cates. On a unanimous vote motion carried.


Motion by Council Member Carnine to proceed with the UV method of disinfection with a guarantee in writing from the engineering firm that the system will meet or exceed DNR requirements, second by Council Member Rupert. On a unanimous vote motion carried.


The Council reviewed the estimates for repairing the Community Hall roof. Discussion included repairing the top block on the south side of the building before proceeding with roof repair.


The Council reviewed the letter of resignation from Connie Pfleeger, Deputy Clerk, noting her years of dedicated service. Motion by Council Member Bargar to accept her resignation with regret, second Council Member Fineran. On a unanimous vote motion carried. Pfleeger will work until December 31st.


Motion by Council Member Carnine to approve the agreement between the City and Ida County to provide transportation services through Siouxland Regional Transit System for the sum of $4667 payable to the County, second by Council Member Cates. On a unanimous vote motion carried.


Motion by Council Member Fineran to close the regular session and open the executive session per State Code 21.5c Litigation, at 7:02 p.m., second by Council Member Cates. Call for votes. Ayes: Fineran, Cates, Rupert, Carnine and Bargar. Nayes: None. Motion carried.


Regular session was reconvened at 7:21 p.m. with the following action. Motion by Council Member Fineran to have the City Attorney defend the lawsuit and further investigate EMC insurance’s decision not to defend the City, second by Council Member Carnine. On a unanimous vote motion carried.


Motion by Council Member Rupert to adjourn, second by Council Member Cates. On a unanimous vote motion carried.
