Mayor Pro Tem Cates presided over the session and called the meeting to order at 6:00 p.m. with the following Council members present:  Fineran, Barger, Carnine and Rupert.  Member absent:  Mayor Ernst

Motion by Council Member Rupert to approve the agenda, second by Council Member Fineran.  On a unanimous vote motion carried. 

Council discussed the Ida Grove Public Library Ordinance, 4-1.02, on board member’s residency requirement to be within the county and term of office be reduced six to four years.   This will be discussed with the county supervisors, and City Clerk Ball was instructed to work with Library Director Rikki Ullrich on a new ordinance. 

Motion by Council Member Rupert to approve the consent agenda, second by Council Member Fineran.  On a unanimous vote motion carried.

City Clerk Ball reported the Iowa Association of Municipal Utilities will be assessing information from the water department to determine the appropriate rate. 

Council discussed utility bill averaging and the difficulties encountered with customer billing.  City Clerk Ball was instructed to prepare an ordinance to change reading meters in alternate months to every month. 

Council discussed tree removal required by The Corps of Engineers Flood Damage Reduction Project, and the possibility of a tree variance.  The Council will wait for a response on the variance from the Corps.  

Motion by Council Member Carnine for City Clerk Ball to attend the Iowa Municipal Finance Officers Association meeting, and Data Technologies Fall User Group meeting on October 15-17, second by Council Member Rupert.  On a unanimous vote motion carried.

Motion by Council Member Rupert to close the regular session and open the executive session per State Code 21.5c Litigation, at 6:20 p.m., second by Council Member Bargar.  Call for votes:  Ayes:  Cates, Fineran, Barger. Rupert, Carnine.  Nays:  None.  Absent:  Mayor Ernst.  Motion carried.

Motion by Council Member Fineran to close the executive session with no motions or actions taken at 6:27 p.m. and reopen regular session.   Call for votes:  Ayes:  Cates, Fineran, Barger, Rupert and Carnine.  Nays:  None.  Absent:  Mayor Ernst.  Motion carried. 

Motion by Council Member Fineran to accept the MTBE settlement, second by Council Member Bargar.  On a unanimous vote motion carried.

Motion by Council Member Rupert to adjourn, second by Council Member Bargar.  On a unanimous vote motion carried.
